Sunday, August 2, 1840: Today my son Geo P took the two horse team and carried his two oldest sisters to Lebanon to the Shaker Meeting.[private] He had his whip stollen from the wagon while in meeting and towards night I took said team and rode up to Nathan Howard’s to see about his tending to my suit with Wm Chapman.
Monday: We hayed. Today Nathan Howard ans to my court in defence with Wm. Chapman and it was before Squ Leland Sheldon and it was adjourned to the 14th of the present month to Simon Cranston’s and on this evening I sent my son Geo P to Nathan Howard’s to get information what he had done for me concerning my court with said Chapman.
Saturday: We hayed. On this evening I walked over to brother Simeon Wylie’s to notify him that I wanted his testimony on the 14 of the month on my defense.
Sunday: Today I took my two-horse team and carried my wife to cousin Samuel Holcomb and left her while I rode to Berlin at Hammond Village to see Lotridge to defend my suit with said Chapman but he was not to home and I left word at his house I would call tomorrow and see him for council.
Monday: This morning at two o’clock I started for Berlin. Cousin Samuel Holcomb went with me to see Mr. Lotridge and he agreed to defend my case with Wm Chapman. We stopped at the old stand called Hammond’s at Streeter’s and I paid 19 cts for brandy and gin and then we returned home and I got home by noon.
Wednesday: Today Mr. James Chapman and wife called and took dinner with us and quite a hard shower.
Friday: This morning I subpoened Alonzo Rodgers and rode to Lebanon after Mrs. Eunice Sackett for a witness and fetched her to my house to dinner and this afternoon I took my covered wagon and carried my son Geo P and daughter Angeline and Mrs. Sackett and Mr. Merrels and Mr. Sheldon to Mr. Simon Cranston’s to where my court was to be with Wm Chapman and he had withdrawn the suit. Mrs Sackett and my daughter stopped to Samuel Holcomb’s to wait until they are needed to go into court when called for. I returned six witnesses to Squ Sheldon that was to S. Cranston’s and two that was to Samuel Holcomb’s. Said Squ Sheldon told me that I had one dol and fifty cts due me for my witnesses and supoenas witnesses that was due me from the court. I then returned from said Squ Sheldon’s to Cranston’s where my witnesses and I paid twelve cts for grog to treat a part of my witnesses. We then returned home. Today I got word from Berlin from my council Squ Lotridge that he could not attend to my suit on account of sickness in his family. I then got Platt Wylie to go to Hancock after Doctor Thomas for council but he was not to home and Ora Holcomb went after Christopher Clifford but could not get him and it was good luck that I could not get any council for the suit being withdrawn.
