Charges against the Beer Diviner and an employee of Cumberland Farms for selling alcohol to a minor were all dismissed in Stephentown Court last week. [private]The two, Jonathan Post of Cherry Plain, owner of the Beer Diviner Tap Room & Market in Stephentown, and Jana Nelson of Stephentown, a clerk at the Cumberland Farms store there, were caught up in July in a sting conducted by State Police. Both were charged with one count of Unlawfully Dealing with a Child, a class A misdemeanor.
According to local attorney Brian Baker, both matters “were dismissed in the interest of justice.” Baker said that both defendants had completed an Alcohol Training Awareness course registered by the New York State Liquor Authority and both were “first offenders” without any prior citations.[/private]
